TERMS AND CONDITIONS OF BUSINESS.
Booking
A 50% deposit is required within 48 hours of receiving our booking confirmation to secure your reservation with us. The remainder of the fee is due 4 weeks before the start of your course, holiday or charter.
Insurance
Your Yacht fully equipped to RYA standards is fully insured against accident and third party liability. It is a condition of booking with Canary Sail that all clients are insured against the usual risks of travel and sailing/motor cruising holidays including personal accident, injury, loss of charter, training holiday and cancellation including flights if applicable. Please note that our third party liability insurance is limited to 336,566 euros in line with Spanish regulations, as opposed to 2,000,000 pounds sterling in the UK. If you require a higher insurance coverage please speak to your own Insurance broker.
Cancellation
If due to unforeseen circumstances you find it necessary to cancel the booking we hope that your loss will be minimised due to our insistence on adequate insurance cover. All cancellations must be received in writing prior to your departure date. A cancellation charge of 25% will be made for cancellations received up to 8 weeks prior to ‘Start Date’. If cancellation is made less than 8 weeks before ‘start date’ the cancellation fee will be equal to the ‘Total Fee’. In the event of a course, holiday or charter being cancelled by Canary Sail due to circumstances beyond our control our liability will be limited to the return of all fees already paid.
Please note: Once a deposit has been received for your chosen yacht, the yacht choice cannot be changed/upgraded within 8 weeks of “start date”. For any changes made prior to the 8 week mark (subject to availability), an administration fee of €90 will apply.
Damage or Loss of Equipment
All damages and losses attributed to carelessness will be paid for by the client at replacement cost.
Charter
In addition to the above the following are applicable to bareboat and skippered charter. A security deposit of €2000 euros is payable before commencement of a charter. The insurance excess in case of damage will be deducted from the security deposit. The cost of fuel used, losses or unauthorised expenses will also be charged against the security deposit. The security deposit or balance thereof will be returned within 14 working days of the safe return of the yacht. The security deposit will normally be taken by VISA or MASTERCARD.
It is the charterers responsibility to report to Canary Sail all groundings, collisions and/or damage to the vessel and give full details in the Ships Log.
Canary Sail reserves the right to take a charter crew on a short familiarisation trip if they appear to be lacking in experience in the craft they are chartering and to provide a skipper at the charterer’s expense if this is felt necessary.
Canary Sail reserves the right to refuse to hand over the vessel to anyone who in the Company’s opinion is not suitable to take charge.
Post charter cleaning is not included in the Charter fee.
Late return of the vessel will result in a charge of twice the daily rate for every day or part day by which redelivery is delayed. If an attempt to return the yacht would endanger the yacht and/or her crew the late return fee may be waived. The Company must be informed as soon as possible if this event is likely to occur. If the yacht requires retrieval from another port, a fee of 200 euros/day, per crew plus expenses (max. 2 crew may be required depending on distance and weather conditions) plus reasonable travel and expenses will be deducted from the deposit.
Change of Vessel & Individual Berths
Canary Sail reserves the right to introduce other vessel types other than those published. Clients booking individual berths will be placed on the vessel which in the Company’s opinion is the most suitable.
Flights
It is your responsibility to arrange flight and transfers to arrive at chosen sailing destination.
Disputes
At Canary Sail we try hard to provide the very best service but on occasions disputes can arise. In case of a dispute, please inform the School Principal or Chief Instructor immediately and we will endeavor to resolve the problem at the time. In all cases, our local staff must be informed of the details prior to your departure and written details forwarded to our office within 14 days. The contract will be construed in accordance with Spanish Law to which both parties submit.
